The Regulations on the Protection and Development of Taijiquan in Jiaozuo City, drafted by Lawyer Jin Yan, were approved and implemented by the Standing Committee of the Provincial People"s Congress

The Regulations on the Protection and Development of Taijiquan in Jiaozuo City (hereinafter referred to as the "Regulations"), drafted by Jinyan lawyers Zhang Fuling and Xiong Zhiwei, were passed at the sixth meeting of the Standing Committee of the 14th People's Congress of Jiaozuo City on September 7, 2023, and approved at the fifth meeting of the Standing Committee of the 14th People's Congress of Henan Province on September 28, 2023. Effective December 17, 2023.

According to the annual local legislation plan of the Standing Committee of the Municipal People's Congress, the Municipal Culture, Radio, Film and Tourism Bureau led the establishment of the "Regulations" research and drafting leading group and special working group, entrusted the Jiaozuo City sports, law, intangible cultural heritage protection and other experts to draft the "Regulations (draft)", and the part-time lawyers of our firm Zhang Fuling and Xiong Zhiwei participated in the whole process, after many joint studies, repeated revisions, argumentations and reviews. It has made positive contributions to the introduction and implementation of the Regulations. "Regulations" a total of 33, using a simple style without chapters, the content is sorted according to the general provisions, protection and inheritance, communication and development, legal responsibility, supplementary provisions of five parts, defines the concept of tai chi, clear protection and management responsibilities, publicity and popularization of the relevant content, pointed out the direction of tai chi industry integration and development.

At the same time, it marks that the protection and development of Taijiquan in Jiaozuo City has entered a new stage led by the rule of law, which plays an important role in strengthening the construction of the protection and development system of Taijiquan, improving the standardized management level of Taijiquan, and promoting the high-quality protection and development of Taijiquan. Jiaozuo City Tai chi protection and development regulations

On September 7, 2023, the sixth meeting of the Standing Committee of the 14th Jiaozuo City People's Congress passed the "Jiaozuo City Tai Chi Protection and Development Regulations" (hereinafter referred to as the "Regulations"). On September 28, the fifth meeting of the Standing Committee of the 14th People's Congress of Henan Province approved the regulations. On October 23, the Standing Committee of the Jiaozuo City People's Congress officially announced the Regulations, and it was officially implemented on December 17, 2023.

Article 1 These Regulations are formulated in accordance with the Intangible Cultural Heritage Law of the People's Republic of China, the Regulations of Henan Province on the Protection of Intangible Cultural Heritage and other laws and regulations for the purpose of protecting and developing Taijiquan, carrying forward the excellent traditional Chinese culture, and promoting the construction of socialist culture with Chinese characteristics, and in light of the actual conditions of this Municipality.

Article 2 These Regulations shall apply to the protection, inheritance, dissemination and development of Taijiquan within the administrative area of this Municipality.

Where there are no provisions in these Regulations, the provisions of relevant laws and regulations shall apply.

Taijiquan as mentioned in these Regulations refers to the traditional sports practice formed in Chenjiagou Village, Wenxian County, Jiaozuo City, which has been included in the representative list of the intangible cultural heritage of mankind, based on the traditional Chinese philosophical thoughts and health concepts of yin-yang cycle and the unity of heaven and man, and characterized by the middle and right circle activity.

Article 3 The objects of Tai Chi protection include:

(1) the boxing theory, boxing method, exercises and routines of Taijiquan;

(2) the boxing spectrum, atlas and lineage of Taijiquan;

(3) Buildings, places, facilities, relics and their appendages related to Taijiquan, such as ancestral temples, former residences of celebrities, inscriptions and inscriptions;

(4) Traditional customs, folk stories, audio-visual archives and oral histories related to Taijiquan;

(5) Other objects related to Tai Chi that need to be protected.

Article 4 The protection and development of Tai chi shall adhere to the leadership of the Communist Party of China, follow the principles of government leadership, social participation, protection, rational utilization, openness and inclusiveness, integrity and innovation.

Article 5 The municipal, county (city) and district people's governments shall strengthen the leadership of the protection and development of Taijiquan, incorporate it into the national economic and social development plan, establish and improve the coordination mechanism for the protection and development of Taijiquan, and the required funds shall be included in the financial budget at the corresponding level.

Township people's governments and sub-district offices shall assist in the protection and development of Taijiquan within their jurisdiction.

Article 6 The competent departments of culture and tourism of the municipal, county (city) and district people's governments shall be responsible for the supervision and administration of the protection and development of Taijiquan within their respective administrative areas.

Development and reform, education, civil affairs, finance, human resources and social security, natural resources and planning, housing and urban-rural construction, commerce, health, sports, market supervision, foreign affairs and overseas Chinese affairs and other departments shall do a good job in the protection and development of Taijiquan within their respective responsibilities.

Article 7 Wushu associations and Taijiquan associations are encouraged to play their role as organizations and Bridges for the protection of Taijiquan in accordance with the articles of association, carry out taijiquan publicity and popularization and exchange activities, and promote the protection and development of taijiquan.

Encourage units and individuals to participate in the protection and development of tai chi by donation, funding and other ways.

Article 8 The week of December 17 every year is Jiaozuo Tai Chi Protection and Publicity Week.

The municipal, county (city) and district people's governments and their relevant departments shall take advantage of important time points such as cultural and natural Heritage Day, National Fitness Day and Municipal Tai Chi protection Publicity Week to organize and carry out Tai Chi publicity and promotion activities, raise the awareness of Tai Chi protection and promote the heritage of Tai Chi culture.

Article 9 The culture, tourism, sports and other departments of the municipal and Wenxian people's governments shall carry out Taijiquan resource investigation, establish Taijiquan archive database and database, and do a good job in the collection, sorting and interpretation of Taijiquan boxing methods and routines.

Encourage units and individuals to provide tai Chi resource clues, donate or entrust all their tai Chi related materials and objects to Tai Chi protection units for collection, storage and display.

Article 10 The municipal and Wenxian people's governments shall delimit the scope of protection for the buildings, places, facilities, relics and their appendages related to the protection of Taijiquan, establish special archives, and take effective measures to protect them.

No unit or individual shall occupy or destroy buildings, places, facilities, relics and their appendages related to Tai Chi protection.

Article 11 The municipal and Wenxian people's governments shall strengthen the construction of Taijiquan cultural ecological protection areas, build taijiquan characteristic villages and blocks, and implement regional overall protection for the core areas of taijiquan practice such as Chenjiagou Village in Wenxian County.

12th city, Wen County people's government culture and tourism departments shall, together with relevant departments, guide tai chi protection units and representative inheritors to register trademarks, apply for patents, protect their intellectual property rights according to law.

Article 13 The competent department of culture and tourism of the municipal and Wen County people's governments shall formulate plans for the protection and development of Taijiquan and determine the units for the protection of Taijiquan. The protection unit should have relatively complete information about tai chi, have the ability to implement protection and development planning, and carry out heritage, display activities and conditions.

Article 14 Tai Chi protection units shall enjoy the following rights:

(1) Conducting resource investigation and research on Taijiquan;

(2) Organize and carry out activities such as tai chi training exchange, exhibition and performance;

(3) Recommending representative successors of Taijiquan;

(4) Using special funds for the protection and development of Taijiquan in accordance with regulations;

(5) providing taijiquan related products and services to other units or individuals according to law;

(6) Other rights related to the protection and development of Tai Chi.

Article 15 Taijiquan protection units shall perform the following obligations:

(1) To formulate Tai Chi protection and development plans and organize their implementation;

(2) Collecting physical objects and materials of Taijiquan, and registering, sorting out and filing;

(3) Protecting places and facilities related to Taijiquan;

(4) to carry out taijiquan publicity and promotion activities;

(5) To provide necessary conditions for the protection and inheritance of Tai Chi;

(6) Regularly report the protection and development of Tai Chi and the use of special funds to the competent departments of culture and tourism;

(7) Other obligations related to the protection and development of Taijiquan.

If the Taijiquan protection unit fails to perform the obligations prescribed in the preceding paragraph without justifiable reasons, the competent department of culture and tourism of the municipal and Wenxian people's governments shall cancel its Taijiquan protection unit qualification according to law.

Article 16 The competent department of culture and tourism of the municipal and Wenxian people's governments shall, in accordance with the principles of openness, fairness and justice, identify and announce the representative inheritors of Taijiquan at this level, and evaluate the inheritance activities in accordance with relevant provisions.

17th Tai chi representative inheritors enjoy the following rights:

(A) to carry out Taijiquan teaching, display, research and other activities;

(2) Training Taijiquan inheritors;

(3) Enjoy representative inheritors' subsidies in accordance with regulations;

(4) To put forward opinions and suggestions on the protection and development of Taijiquan;

(5) Other rights related to the protection and development of Tai Chi.

Article 18 Representative successors of Taijiquan shall perform the following obligations:

(1) Carry out Tai Chi heritage activities to train successor talents;

(2) Cooperate with departments of culture, tourism, sports and other departments to conduct taijiquan resource survey and database construction;

(3) To participate in learning and training, exchanges and discussions, exhibitions, public welfare publicity and other activities;

(d) to report to the competent authorities of culture and tourism on the status of inheritance and accept the assessment of their heritage activities by the competent authorities of culture and tourism;

(5) Other obligations related to the protection and development of Taijiquan.

Article 19 If a representative inheritor of Taijiquan has any of the following circumstances, the competent department of culture and tourism of the municipal and Wenxian people's governments shall cancel his representative inheritor qualification according to law:

(1) losing the nationality of the People's Republic of China;

(2) obtaining qualifications by resorting to fraud or other improper means;

(3) failing to perform the obligations without justifiable reasons and failing to pass the assessment twice in aggregate;

(4) violating laws, regulations or social ethics, causing major adverse social impact;

(5) Voluntarily giving up the qualification of representative inheritors;

(6) Other circumstances that should be cancelled.

Article 20 The special funds for the protection and development of Taijiquan shall be used for the following projects:

(1) Taijiquan resource survey and digital construction;

(2) the collation, research, publication and translation of Taijiquan literature and materials;

(3) Maintenance and construction of buildings, places, facilities, relics, etc. related to the protection of Tai Chi;

(4) Support for Tai Chi protection units and representative inheritors and training of talents;

(5) the exchange and discussion of Taijiquan, exhibition and performance, publicity and promotion, and the organization and implementation of major competitions;

(6) Awards to units and individuals that have made outstanding contributions to the protection and development of Taijiquan;

(7) Other work related to the protection and development of Taijiquan.

Article 21 The human resources and social security department of the municipal people's government shall, in conjunction with the sports, culture and tourism departments, establish and improve the Taijiquan talent identification system, improve the talent training and security mechanism, and promote the construction of Taijiquan talent team.

Article 22 The education departments of the municipal, county (city) and district people's governments are encouraged to incorporate Taijiquan into physical education and health teaching in primary and secondary schools.

Encourage vocational colleges to carry out taijiquan personnel training.

Support institutions of higher learning to carry out Taiji-related research, set up Taijiquan college (department), Taijiquan laboratory and other teaching and research institutions, and train Taijiquan professionals.

Article 23 The municipal, county (city) and district people's governments shall set up places for the dissemination of public welfare tai Chi, organize the preparation of simple and easy to learn, unified and standardized tai Chi promotion routines, and support the development of tai chi into organs, enterprises, schools, communities, and rural areas by means of government purchase services, social funding, public welfare performances, etc.

Article 24 The municipal people's Government shall determine the brand identification of Taijiquan in this municipality.

Municipal and county (city) departments of natural resources and planning, housing and urban and rural construction should reasonably apply brand logos and classic elements with Tai Chi cultural characteristics to public places.

25th city, county (city), district people's governments should fully tap Taijiquan culture, improve Taijiquan cultural tourism, heritage and practice supporting facilities, promote the development of taijiquan experience, leisure, research, roots and other cultural tourism projects, and promote the integrated development of taijiquan cultural tourism, cultural and creative industries.

Article 26 Encourage units and individuals to create literary, fine arts, calligraphy, music, dance, film and television, drama and other cultural and artistic works that reflect the elements of Taijiquan; Develop Taijiquan performance, competition, teaching brands, expand Taijiquan performance, games, animation and other cultural and creative industries, and lengthen training, clothing, equipment and other related industrial chains.

Article 27 Encourage units and individuals to carry out activities related to taijiquan through the Internet platform, such as exhibition, online teaching and curriculum development, and cultivate and develop new forms of media communication.

28th city, county (city), district people's governments should rely on Jiaozuo landscape, residential clusters and other resources advantages, give full play to Taijiquan learning and understanding, self-cultivation and physical fitness and other functions, to build a health and health destination integrating health and cultural inheritance.

Article 29 The municipal and Wenxian people's governments shall strengthen the cultural exchange and dissemination of Taijiquan, build an exchange platform for international and domestic Taijiquan events, regularly hold "China Jiaozuo International Taijiquan Competition" and other events exchange activities, and promote the continuous improvement of the influence of the birthplace of Taijiquan.

Article 30 The municipal and Wenxian people's governments shall strengthen exchanges and cooperation with the people's governments at the same level where other Taijiquan inheritance concentration areas are located, establish and improve the protection regional cooperation mechanism, and improve the level of Taijiquan protection and inheritance.

Article 31 Where the culture, tourism and other departments of the municipal, county (city) or district people's governments and their staff commit any of the following acts, the persons directly in charge and other persons directly responsible shall be given sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Withholding, misappropriating, or diverting special funds for the protection and development of Taijiquan;

(2) Illegally occupying or damaging Taijiquan materials, objects, places or facilities;

(3) favoritism, malpractice and fraud in the process of identifying the representative inheritors of Tai Chi;

(4) other acts of abuse of power, dereliction of duty, favoritism and malpractice.

Article 32 Where laws and regulations already provide for legal liability for acts violating the provisions of these Regulations, such provisions shall prevail.

Article 33 These Regulations shall come into force as of December 17, 2023.
